A federal court has issued preliminary approval for a $33 million class action settlement involving Wells Fargo & Company. If you were charged for “risk-free” trials or unwanted monthly subscriptions through a Wells Fargo account, you may be entitled to a cash payment.
The lawsuit, McNamara v. Wells Fargo & Co., alleges that the banking giant knowingly assisted several entities specifically the Tarr, Triangle, and Apex Entities in operating deceptive subscription scams. These schemes lured consumers with “free trials” where they only had to pay for shipping, only to be hit later with full-price monthly charges without their consent.
Are You Eligible for a Payout?
The settlement class includes anyone in the United States who was enrolled in recurring billing by any of the Tarr, Triangle, or Apex entities from 2009 to the present.
If you noticed unauthorized charges on your bank statements for dietary supplements, electronic cigarettes, or skin care products linked to these entities, you are likely part of this class.
How Much Can You Receive?
The amount of compensation depends on the documentation you can provide:
- With Proof of Loss: Class members who submit valid claim forms along with documented proof (bank statements, credit card records, or receipts) are eligible for a pro-rated cash payment based on their total out-of-pocket losses.
- Without Proof of Loss: If you do not have receipts but were enrolled in the recurring billing, you can still claim a one-time cash payment of up to $20.
Critical Deadlines You Need to Know
To receive your share of the $33 million fund, you must act before the court-mandated deadlines:
- Claim Form Deadline: March 4, 2026.
- Exclusion/Objection Deadline: March 5, 2026.
- Final Approval Hearing: Scheduled for March 26, 2026.
Note: If you previously received a refund from the Federal Trade Commission (FTC) regarding Triangle or Apex entities, you may not need to file a new claim. However, those linked to Tarr Entities must submit a form to be eligible.
